If the nuclear accident is expected to exceed the prescribed liability limit, a nuclear accident detection committee will be set up by the President of the Republic within two months from the date of the nuclear accident to evaluate the application. By people who have suffered a nuclear accident to compensate for the nuclear accident and decide on an application. The cost of the committee is covered by the ministry’s budget.

Nuclear damages

Once the committee is established, the nuclear damage caused by the nuclear accident will be compensated by the committee.

The amount corresponding to the liability limit of the business operator is collected by the Ministry of Finance from the business operator or its insurance company, or the guarantee provided by the business operator is converted into cash.

The Commission urges those affected by nuclear weapons to apply to the Commission or other authorities for a period of at least one year and to be determined by determining the expiration date in the announcements it makes.

If filed by a person who has suffered nuclear damage for the purpose of determining or compensating for nuclear damage before the Commission is established, there is no need for a court decision and it is decided based on the file that the costs of the parties will remain. increase. If the total amount of compensation legitimately paid to the applicant exceeds the liability limit, the Commission will develop a payment plan that divides the amounts that make up the liability limit. Unless the nuclear damages are indemnified, if the statute of limitations has not yet been completed, the claim for damages will expire three years after the person suffering the nuclear damages becomes aware of the damages and their liability.

If the Turkish court has jurisdiction over a nuclear case that occurs under the sovereignty of the Republic of Turkey or in accordance with the Joint Protocol on the Treaty of Paris and the implementation of Vienna, only the court of the Republic of Turkey will be authorized.
